Terms of Use
These Terms of Use ("Terms") are an agreement between you and the operator of the FitFairy app ("FitFairy", "we"). By creating an account or using the app you agree to them. If you do not agree, do not use FitFairy. Our Privacy Policy explains how we handle your data and is part of these Terms.
1. What FitFairy is
FitFairy uses artificial intelligence to generate an image of you wearing an outfit from a post or screenshot you provide ("try-on"), and optionally a short animated video of that image ("Fit Check"). Results are AI-generated renderings. They are approximations, not photographs, and they are not a guarantee of how a garment fits, looks, or is sized in real life.
2. Who can use it
You must be at least 13 years old to use FitFairy. If you are under 18, you may only use it with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for any purchases. By using the app you confirm that this is the case.
3. Your account
The app creates an account for you automatically. You may link it to your Apple ID with Sign in with Apple, which is required to start a free trial and lets you keep your fits across devices. You are responsible for activity on your account and for keeping your device secure. You may delete your account at any time from Settings; see the Privacy Policy for what that removes.
4. Your content and the rules for it
You keep ownership of the photos you provide and of the try-ons and Fit Checks generated for you. You grant us the limited license needed to store, process, and display that content in order to provide the service to you. We do not use it for advertising or to train AI models.
You agree that you will only:
- provide a body photo of yourself, or of another person who has given you their explicit permission to use their likeness in this way;
- use outfit images and post links in a way that respects the rights of the people who created them (FitFairy keeps the link back to the original post and never stores the source video);
- use results for personal, non-commercial purposes unless we agree otherwise in writing.
You agree that you will not:
- upload a photo of any person without their consent, or of anyone under 13;
- attempt to generate sexual, nude, violent, hateful, or otherwise harmful content, or content intended to deceive, harass, impersonate, or defame anyone;
- present a generated image or video as a real photograph or as an endorsement by any person or brand;
- reverse-engineer the app, circumvent usage limits or payment, automate access, or use the service to build a competing product;
- use FitFairy in a way that violates any law or the rights of others.
We may remove content or suspend accounts that break these rules. Our AI providers also apply their own safety filters, and some requests may be refused as a result.
5. Plans, trials, and add-ons
FitFairy offers a subscription plan ("Plus") with a monthly allowance of try-ons, and one-time add-on packs of try-ons and Fit Checks. Current prices are shown in the app before you buy. Allowances and prices may change; we will tell you in advance of any change to a plan you are on.
- Payment is charged to your Apple ID through the App Store. Apple's terms also apply.
- Auto-renewal. Subscriptions renew automatically at the end of each period at the price shown at purchase, unless you cancel at least 24 hours before the period ends.
- Free trial. Where offered, a trial converts to a paid subscription at the end of the trial period unless cancelled before then. Only one trial per Apple ID.
- Introductory prices apply for the stated period and then revert to the standard price.
- Cancelling. Manage or cancel in the app under Settings → Manage Subscription, or in iOS Settings → your name → Subscriptions. Cancelling stops future renewals; you keep access until the end of the paid period. Deleting your FitFairy account does not cancel your subscription; you must cancel it with Apple.
- Add-on packs are consumable purchases. Their balances do not expire, are tied to your FitFairy account, and are consumed only after your plan allowance for that period is used up. Because they are tied to your account, deleting your account forfeits any remaining balance.
- Unused allowance in a plan period does not roll over.
- Refunds are handled by Apple under App Store policies; we cannot issue them directly. Request one at reportaproblem.apple.com.
A try-on or Fit Check that fails on our side is not charged against your allowance.
6. Availability and changes
We work to keep FitFairy available, but it depends on third-party AI and infrastructure providers and we cannot promise uninterrupted service. We may change, suspend, or discontinue features, and we may apply rate limits to keep the service stable. We will give reasonable notice of changes that materially reduce a paid plan.
7. Intellectual property
The FitFairy app, name, logo, design, and software are ours or our licensors' and are protected by law. These Terms do not give you any right to use them except to use the app as intended.
8. Disclaimers
FitFairy is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. AI outputs can be inaccurate, unflattering, or unexpected; we do not warrant their accuracy, and you should not make purchasing or other decisions based solely on them.
9. Limitation of liability
To the fullest extent permitted by law, FitFairy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the app. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limits, in which case they apply to the extent permitted.
10. Indemnity
You agree to indemnify us against claims arising from content you provide in breach of section 4, including any claim that you used another person's likeness without their consent.
11. Termination
You may stop using FitFairy and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if required by law. Sections 4, 7 to 10, and 12 to 13 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules. Before bringing a formal claim, you agree to contact us at support@fitfairy.net and give us 30 days to try to resolve it informally. Nothing in these Terms limits any rights you have as a consumer under the law of the place where you live.
13. General
These Terms are the entire agreement between you and us about FitFairy. If any part is found unenforceable, the rest remains in effect. We may update these Terms; if we make material changes we will update the date above and notify you in the app before they take effect. Continued use after that date means you accept the updated Terms.
